Scope: 

The merchandise that is subject to the order is steel wire garment hangers, fabricated from carbon steel wire, whether or not galvanized or painted, whether or not coated with latex or epoxy or similar gripping materials, and/or whether or not fashioned with paper covers or capes (with or without printing) and/or nonslip features such as saddles or tubes. These products may also be referred to by a commercial designation, such as shirt, suit, strut, caped, or latex (industrial) hangers. Specifically excluded from the scope of the order are wooden, plastic, and other garment hangers that are not made of steel wire. Also excluded from the scope of the order are chrome-plated steel wire garment hangers with a diameter of 3.4 mm or greater. The products subject to the order are currently classified under HTSUS subheadings 7326.20.0020 and 7323.99.9060.

Although the HTSUS subheadings are provided for convenience and customs purposes, the written description of the merchandise is dispositive.

 

News:

187 producer/exporters named in Initiation of Administrative Review of Steel Wire Garment Hangers Affecting March 25, 2008 through September 30, 2009 entries.

On November 25, 2009, the U.S. Department of Commerce published its initiation of the administrative review affectiong March 25, 2008 through September 30, 2009 entries of steel wire garment hangers from China.  Many of these companies are currently subject to the 187.25% antidumping duty rate -- which requires that importers pay cash deposits equal to 187.25% of the entered value of the steel wire garment hangers imported into the United States. 

This review presents an opportunity for producer/exporters subject to lower their rates by filing a Separate Rate Application.  These Separate Rate Applications are filed to demonstrate that the producer/exporter is not subject to controll by the Government of China.  Those who successfully filed separate rate applications in the investigation in 2008 enjoy an antidumping duty rate 130 percentage points lower than those who did not.

A Separate Rate Application is typically 300-400 pages, and requires attention to the legal requirements of the U.S. Department of Commerce.  For this reason, it is advisable that Chinese producer/exporters hire an attorney familiar with U.S. antidumping duty law.  A partial list of attorneys can be found on the Law Firms page of this website.

Commerce Excludes Chrome-Plated Steel Wire Garment Hangers with a Diameter of 3.4 mm or Greater from Antidumping Duty Order on Steel Wire Garment Hangers from China.

On October 2, 2009, the U.S. Department of Commerce published  its Final Results of its antidumping duty changed circumstances review.  The Department of Commerce is now revoking the Order, in part, with regard to the following product: chrome-plated steel wire garment hangers with a diameter of 3.4 mm or greater.

Revocation is effective for all entries made on or after March 25, 2008.

The U.S. Customs and Border Protection will not necessarily refund cash deposits made upon entry of this now-excluded merchandise.  If you act now, the U.S. Customs and Border Protection should refund your cash deposits upon request.  If you wait until after the completion of the first antidumping duty administrative review (some time at the end of 2010), you should receive your cash deposit returned with interest.  If your entries are liquidated as entered, you can protest the liquidation and receive a refund of your deposits.

Importers - check the liquidation instructions.  If they do not properly implement the amended final results, you could be required to pay more than the U.S. Government is entitled to receive.
