Case Number: A-469-814 Anniversary Month: June Current Rates: Hebei Jiheng Chemical Corporation, Ltd. - 20.16% China-wide Rate - 285.63% Scope: The products covered by this order are chlorinated isocyanurates. Chlorinated isocyanurates are derivatives of cyanuric acid, described as chlorinated striazine triones. There are three primary chemical compositions of chlorinated isocyanurates: (1) trichloroisocyanuric acid (Cl3(NCO)3); (2) sodium dichloroisocyanurate (dihydrate) (NaCl2(NCO)3 2H2O); and (3) sodium dichloroisocyanurate (anhydrous) (NaCl2(NCO)3). Chlorinated isocyanurates are available in powder, granular, and tableted forms. The order covers all chlorinated isocyanurates. Chlorinated isocyanurates are currently classifiable under subheadings 2933.69.6015, 2933.69.6021, and 2933.69.6050 of the Harmonized Tariff Schedule of the United States (HTSUS). The tariff classification 2933.69.6015 covers sodium dichloroisocyanurates (anhydrous and dihydrate forms) and trichloroisocyanuric acid. The tariff classifications 2933.69.6021 and 2933.69.6050 represent basket categories that include chlorinated isoscyanurates and other compounds including an unfused triazine ring. Although the HTSUS subheadings are provided for convenience and customs purposes, the written description of the scope of the order is dispositive. |

Hebei Jiheng Chemical slapped with 2520% increase in antidumping duty rate affecting shipments entering the United States from June 1, 2007, through May 31, 2008 On December 14, the U.S. Department of Commerce published the Final Results of its administrative review of chlorinated isocyanurates from China affecting June 1, 2007, through May 31, 2008 entries. The Department of Commerce determined that Hebei Jiheng Chemical Corporation, Ltd., was dumping chlorinated isocyanurates in the United States. The Department of Commerce calculated a rate of 20.16% for Hebei Jiheng Chemical. In the previous review, the rate calculated for Hebei Jiheng Chemical was 0.80%. Because of these final results, all entries of Chlorinated Isocyanurates produced and exported by Hebei Jiheng Chemical Corporation made on or after December 14, 2009, must be accompanied by cash deposits of estimated antidumping duties in an amount equal to 20.16% of the entered value. Keep track of the calendar! If the U.S. Customs and Border Protection does not liquidate the June 1, 2007, through May 31, 2008 entries within six months, by law, it must liquidate them as entered. That means that if the entries are not liquidated within six months, by law, you will not be liable for the 2520% increase in US import duties.
