Scope


The petition covers glyphosate (n-(phosphonomethyl) glycine) produced in China in all its forms and concentrations, whether imported into the United States as an acid, wet cake, salt or formulated glyphosate produced in China that is formulated or otherwise processed into a different form or concentration of glyphosate in a third country prior to importation into the United States.  Glyphosate acid, wet cake and salt presently enter the United States under subheading 2931.00.9043 of the Harmonized Tariff Schedule ("HTS").  Formulated glyphosate presently enters the United States under HTS subheading 3808.93.500.
 
 
New Antidumping Duty Petition Filed Against Glyphosate from China.
On March 31, 2010, Albaugh, Inc. ("Petitioner"), filed a petition with the U.S. International Trade Commission and U.S. Department of Commerce seeking antidumping and countervailing duty investigations into glyphosate from China.

Petitioners allege that Chinese glyphosate companies are dumping glyphosate with margins of 299.65% to 349.65%. 

The U.S. International Trade Commission has initiated its investigation into injury.  It will have 45 days to make its preliminary injury determination -- that is, by May 17, 2010. 

The U.S. Department of Commerce will evaluate the petition to determine whether it contains allegations and evidence that is reasonably available to the Petitioners indicating that glyphosate from China is being dumped (sold at less than fair value) in the United States.  If the Department of Commerce determines that the petition is sufficient, it will initiate its investigations into dumping in 20 days -- that is, by April 20, 2010.
