Scope

The merchandise within the scope of these investigations is seamless steel cylinders designed to store and secure gases at high pressure during transport ("high pressure steel cylinders"). High pressure steel cylinders are fabricated of chrome alloy steel including, without limitation, chromium-molybdenum steel or chromium magnesium steel, and marked with the symbol of a U.S. Department of Transportation, Pipeline and Hazardous Materials Safety Administration ("DOT")-approved high pressure steel cylinder manufacturer, as well as with an approved DOT type marking of DOT 3A, 3AX, 3AA, 3AAX, 3B, 3E, 3RT, 3T, or DOT-E (followed by a specific exemption number). High pressure steel cylinders covered by these investigations have a water capacity up to 450 liters, and a gas capacity ranging from 8 to 702 cubic feet, regardless of corresponding service pressure levels and regardless of physical dimensions, finish or coatings.  

Excluded are high pressure steel cylinders manufactured to UN-ISO-9809-1 & 2 specifications and marked with ISO or UN symbols. Also excluded from these investigations are acetylene cylinders, with or without internal porous mass, and marked 8A or 8AL in accordance with DOT regulations.    

Merchandise covered by these investigations is classified in the Harmonized Tariff Schedule of the United States ("HTSUS") under subheading 7311.00.0030. Subject merchandise may also enter under HTSUS subheading 7311.00.0090. Although the HTSUS subheading is provided for convenience and customs purposes, the written description of the merchandise under these investigations is dispositive.


 
 
Petition filed for Antidumping and Countervailing Duty Investigations of High Pressure Steel Cylinders from China.
On May 11, 2011, Norris Cylinder Company, filed a petition with the U.S. International Trade Commission and U.S. Department of Commerce seeking antidumping and countervailing duty investigations into High Pressure Steel Cylinders from China.  Norris Cylinder alleges high pressure cylinders dumping margins of 156.23% to 288.41%.  (This means that the ultimate additional import duty for non-cooperative companies may be as high as 288%!)

For the purposes of AD investigations, dumping occurs when a foreign company sells a product in the United States at less than normal value. For the purposes of CVD investigations, subsidies are financial assistance from foreign governments that benefit the production, manufacture, or exportation of goods.

The merchandise covered by these investigations is high pressure steel cylinders. (For a more detailed description of the scope, see the "Scope" description to the left.)

There are special rules for China:

Once the Department of Commerce initiates its AD investigation, Quantity & Value questionnaires must be filed by all Chinese galvanized steel wire exporters, otherwise they will be penalized for non-cooperation with the highest antidumping duty rate that Commerce can justify. The Quantity & Value questionnaire can be downloaded by clicking on the link above.

All Chinese exporters who file a Quantity & Value questionnaire must also file a Separate Rate Application. The Separate Rate Application can be downloaded by clicking on the link above. Separate Rate Applications must include information and documentation demonstrating that the exporter's pricing decisions are not controlled by any level of the Government of China. It is recommended that U.S. international trade counsel assist in preparing, submitting, and serving your Separate Rate Application. Separate Rate Applications are due 60 days after the date the initiation is published in the Federal Register.
