Scope

The products covered by these investigations include narrow woven ribbons of various woven fibers, less than 12 centimeters in width, and used for decorative purposes such as wrapping a gift box or embellishing apparel.

The products covered by these investigations are currently classified in the Harmonized Tariff Schedule of the United States (HTSUS) under the categories: 5806.32.1020, 5806.32.1030, 5806.32.1050, 5806.32.1060. While the HTSUS subheadings are provided for convenience and customs purposes, Commerce’s written description of the subject merchandise governs the scope of these investigations.
 
Yama Ribbons and Bows Co., Ltd., Escapes with no countervailing duties; Changtai Rongshu Textile Co., Ltd., gets 118.68% all others at 59.49% in Preliminary Determination of the Countervailing Duty Investigation of Narrow Woven Ribbons with Woven Selvedge from China

On December 8, 2009, the U.S. Department of Commerce announced its affirmative preliminary determination in the countervailing duty investigation on imports of narrow woven ribbons with woven selvedge from China.

For the purposes of countervailing investigations, subsidies are financial assistance from foreign governments that benefit the production, manufacture, or exportation of goods.

The Department of Commerce preliminarily determined that Chinese producers/exporters have received net countervailable subsidies ranging from 0.29% (de minimis) to 118.68%.  Mandatory respondent, Yama Ribbons and Bows Co., Ltd., received a net subsidy rate of 0.29% (de minimis).  As mandatory respondent Changtai Rongshu Textile Co., Ltd., did not respond to the request by the Department of Commerce for information, it received a net subsidy rate of 118.68% based on adverse facts available. All other Chinese exporters received a net subsidy rate of 59.49%.

As a result of this preliminary determination, Commerce will instruct U.S. Customs and Border Protection to collect a cash deposit or bond based on these preliminary rates, except for imports of merchandise produced by Yama Ribbons and Bows Co., Ltd.

The Department of Commerce aligned its countervailing duty investigation with the antidumping duty investigation, thus, the final determination will not likely be issued for several months.  IMPORTERS - you will only be required to make cash deposits or post bonds for 4 months from the date the Preliminary Determination is published in the Federal Register.  After 4 months from that date until the Final Determination is published, the United States, by law, is prohibited from requiring or subsequently collecting countervailing duties.
