Affected entries made from August 1, 2008, through July 31, 2009. If the administrative review is for the first year after the antidumping or countervailing duty order was issued, entries made from the date the preliminiary determination was published through issuance of the order will also be affected by the administrative review. Initiations Summary: The U.S. Department of Commerce announced initiation of administrative reviews of 211 companies under 14 different orders. These results will determine the final antidumping and countervialing duties to be collected on entries made from August 1, 2008, through July 31, 2009. Administrative reviews may be rescinded if every party requesting a review of a particular company withdraws their request within 90 days of initiation (that is, by December 21, 2009). The review may also be rescinded if the producer or exporter had no shipments of merchandise covered by the particular order during the August 1, 2009, through July 31, 2009 time period and files a letter claiming no shipments within 30 days of publication of the Initiation (that is, by October 22, 2009). Respondent selection is typically completed by analyzing U.S. Customs & Border Protection import data. These confidential data will be released within 5 days (by September 28) to parties whose attorneys have been approved for access to the confidential data. Any comments to clarify the import data must be received before the Department of Commerce makes its decision selecting respondents, which it does 20 days after publication of the initiations (that is, by October 12, 2009) For reviews of orders on merchandise from China or Vietnam, the Department of Commerce assumes all producers and exporters are subject to their government's control, and thus will received a country-wide rate -- usually an extremely high rate. Producers and exporters may receive a separate rate by filing a separate rates certification for China or a separate rates certification for Vietnam within 30 days of of initiation of the notice of initiation (that is, by October 22, 2009), and a separate rates aplication for China or a separate rates aplication for Vietnam within 60 days of the notice of initiation (that is by November 23, 2009). The separate rate typically is the much lower average of the rates calculated for companies selected for individual review.
