U.S. Department of Commerce Terminates Countervailing Duty Investigation of Ni-Resist Piston Inserts from Korea, Finds Subsidies at Rate of 6.81% for Argentina in Final Countervailing Duty Determination.

Scope:

The scope of this investigation includes all Ni-resist piston inserts regardless of size, thickness, weight, or outside diameter. Ni-resist piston inserts may also be called other names including, but not limited to, "Ring Carriers," or "Alfin Inserts." Ni-resist piston inserts are alloyed cast iron rings, with or without a sheet metal cooling channel pressed and welded into the interior of the insert. Ni-resist piston inserts are composed of the material known as Ni-resist, of the chemical composition: 13.5%-17.5% Ni (nickel), 5.5%-8.0% Cu (copper), 0.8%-2.5% Cr (chromium), 0.5%-1.5% Mn (manganese), 1.0%-3.0% Si (silicon), 2.4%-3.0% C (carbon). The cast iron composition is produced primarily to the material specifications of the American Society for Testing and Materials (ASTM), ASTM A-436 grade 1.

The scope of this investigation does not include piston rings nor any other product manufactured using the Ni-resist material.

The subject imports are properly classified under subheading 8409.99.91.90 of the HTSUS, but have been imported under HTSUS 7326.90. The HTSUS subheadings are provided for convenience and customs purposes. The written description is dispositive of the scope of this investigation.

Summary:  The U.S. Department announced its final determination in the countervailing duty investigation of Ni-Resist Piston Inserts from Argentina and Korea.  For Argentina, mandatory respondent, Clorindo Appo SRL, received a final subsidy rate of 6.81 percent. Because Clorindo Appo SRL was the only respondent, all other Argentine producers/exporters also received a final subsidy rate of 6.81 percent.

For Korea, mandatory respondent, Incheon Metal Co., Ltd. (Incheon Metal), received a countervailable subsidy in the form of interest assistance and received tax benefits under the Namdong National Industrial Complex Program; however, the amounts provided were so small that they did not result in an affirmative net subsidy rate. Because Incheon Metal was the only respondent, all other Korean producers/exporters have also received a final de minimis subsidy rate.

Commerce will instruct U.S. Customs and Border Protection to collect a cash deposit or bond on imports of piston inserts from Argentina based on the rates in the final determination. Commerce will not instruct U.S. Customs and Border Protection to collect a cash deposit or bond on imports of piston inserts from Korea. Instead, Commerce will terminate the countervailing duty investigation on imports of piston inserts from Korea.

The U.S. International Trade Commission is expected to make its final injury determination regarding imports from Argentina only by October 29, 2009.

Importers of Ni-Resist Piston Inserts from Korea should have all cash deposits, bonds, or other securities refunded or released by U.S. Customs & Border Patrol.
